Parties to the Waiver
In consideration of the services of Living Sword Martial Arts LLC, and it's representatives, I, on behalf of myself and jointly and severally, on behalf of minor child(ren), if any is/are listed as participants below, and on behalf of our respective heirs, personal representatives, spouse, next of kin, successors, and assigns (hereinafter collectively "I (we)"), hereby understand, acknowledge, and voluntarily agree with Living Sword Martial Arts LLC, it's shareholders, officers, directors, employees, agents, contractors, representatives, insurers, and/or landlords, and each of their successors and assigns, including any and all related company names doing business as (dba's) (herein after collectively the "DOJO").

Payment of Membership Dues
I (we) agree to pay all membership dues on or before the first day of each month on a month-to-month basis until either party shall terminate this agreement according to the terms listed below. All payments are to be made by check or money order and cash shall be acceptable. Failure to render payment shall result in termination of membership.

Fees Not Included in Membership Dues
It is understood that payment of membership set out above does not include payment for rank test fees (belt and certification), uniforms or equipment, which payment shall be made to and arranged with THE DOJO.

Termination of Membership
This membership may be terminated at any time for any reason by the MEMBER or by THE DOJO.

Use of Member's Likeness
I (we) agree that THE DOJO may use MEMBER'S name and likeness alone or with others, in advertising and promoting THE DOJO and its programs in all media.

Indemnity and Agreement not to Sue
I (we), hereby both freely and voluntarily give my (our) consent and approval for participation in the sports program described on this form, and further, agree individually to the terms of the waiver, release, covenant not to sue and indemnity agreement as set forth herein below.

Emergency Medical Treatment
In case of injury or illness, I (we) give my (our) consent to emergency transportation and the administration of any first aid, medical and/or dental treatment and I (we) accept responsibility for the payment of any such emergency transportation and treatment expenses and any related or subsequent medical bills.

Assumption of Risk
I (we) understand that there are inherent risks in the practice of martial arts, including physical injury and even death. I, assume all risks and hazards incidental to such participation, including, but not limited to, physical injury and transportation to and from activities; and I (we) hereby waive, release, absolve, indemnify and agree to hold harmless THE DOJO, the program coaches, sponsors, supervisors, participants, person(s) transporting me (us) and, THE DOJO members, officers, directors, employees, volunteers, agents or any other representatives of THE DOJO, from and against any and all causes of action, claims, demands, losses, expenses or liability of any nature whatsoever, in law or in equity, arising from the activities contemplated hereby. In the same capacities, I (we) covenant and agree not to sue THE DOJO, the program coaches, sponsors, supervisors, participants, and person transporting me, THE DOJO members, officers, directors, employees, volunteers, agents or any other representatives of THE DOJO, for any such causes of action, claims, demands, losses, expenses or liability. I (we) understand that conduct by me (us) deemed inconsistent with the rules of sportsmanship and fair play, could result in expulsion from this or any other THE DOJO sponsored activity or program.

I (we) have fully read this document, understand its meaning and the legal impact thereof, have had the opportunity to have my/our attorney review this document and explain it to me (us) prior to signing my (our) name below and I (we) voluntarily, of my (our) own free will and without distress or coercion sign this Membership Agreement and Liability Waiver and Release.
